1. Who you are contracting with
The Realty Sign Pro service is provided by Glenn Morrissette, doing business as Realty Sign Pro ("Realty Sign Pro", "we", "us", "our"). By creating an account, accessing, or otherwise continuing to use the service, you agree to be bound by these Terms & Conditions.
2. The service
Realty Sign Pro provides electronic signature, document management, and audit-trail tools for real estate professionals. The service may evolve, and features may be added, changed, or removed.
3. Eligibility and account
You must be at least 18 years old and able to enter into a binding contract. If you use the service on behalf of an organisation, you confirm that you have authority to bind that organisation. You are responsible for keeping your credentials confidential and for all activity under your account, and for providing accurate information and keeping it up to date.
4. Acceptable use
You must not, and must not allow others to:
- Use the service unlawfully, fraudulently, or to send spam.
- Infringe the intellectual property or privacy rights of others.
- Upload malware or interfere with the security or integrity of the service (including probing, scanning, scraping, or circumventing technical limits).
- Reverse engineer, decompile, resell, or redistribute the service.
- Use the service to forge documents or impersonate any person.
5. Intellectual property
Realty Sign Pro and all related software, documentation, trademarks, and branding remain the property of Glenn Morrissette and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have purchased. You retain ownership of content you upload, and grant us a limited licence to host and process that content solely to provide the service.
6. Payments and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refunds are governed by Paddle's Buyer Terms in addition to our refund policy.
Subscriptions renew automatically at the end of each billing period at the then-current rate until cancelled. You can cancel at any time from your billing page or via Paddle. Cancellation takes effect at the end of the current billing period.
7. Service level
We make commercially reasonable efforts to keep the service available, but do not guarantee uninterrupted or error-free operation. Scheduled maintenance and events beyond our reasonable control (force majeure) may temporarily affect availability.
8. Warranties and disclaimers
To the fullest extent permitted by law, the service is provided "as is" and "as available". We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you paid in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where such limitation is not permitted by law.
10. Indemnity
You will indemnify and hold us harmless from third-party claims arising from your content, your use of the service in breach of these terms, or your violation of law.
11. Suspension and termination
We may suspend or terminate your access at any time for: material breach of these terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may cancel at any time. On termination, your right to use the service ends and we may delete your data after a reasonable export window in accordance with our Privacy Notice.
12. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which Glenn Morrissette is established, without regard to conflict-of-laws rules. The competent courts of that jurisdiction have exclusive jurisdiction, except where mandatory consumer protection law gives you the right to bring a claim in your local courts.
13. Assignment and changes
You may not assign these terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets. We may update these terms from time to time; we will notify you of material changes by email or in-app notice before they take effect.
